A name, possibly including a graphic, that is used as an Identifier used in trade.

Context

  • The covers the use of legal and common trademarks, trade names, service marks and similar.[1]

Problems

Even when a trademark is legally registered, Fair Use terms may apply and so the mark cannot considered to be definitive expect by context.
